Terms and Conditions of Use

1. Introduction

Welcome to Nero Bay, a text-based MMO RPG operated by VisualTech Studio ("we", "our", "the Operator"), headquartered in Romania. By accessing or using the Nero Bay game, available at nerobay.online ("the Service", "the Game", "the Platform"), you accept these Terms and Conditions ("the Terms"). If you do not agree, please do not use the Service.

2. Eligibility

  • You must be at least 18 years old to use Nero Bay.
  • By creating an account, you confirm that you are of legal age.
  • If you are a minor, you are not permitted to create an account or use the Service.
  • We reserve the right to request age verification at any time.

3. User Account

  • You can create an account using email/password or through OAuth authentication (Discord, Google).
  • You are responsible for the security of your account, including your password and active sessions.
  • One account per person. Multiple accounts ("multi-accounting") are prohibited.
  • You may not sell, transfer, or share your account with other people.
  • We reserve the right to suspend or delete accounts that violate these Terms.

4. Game Content

Nero Bay is a fictional game with a criminal theme, set in a fictional city between 1990–2015. All in-game activities (crimes, money laundering, PvP fights, gangs) are purely fictional and do not promote or encourage illegal activities in real life.

  • The game content is intended solely for entertainment.
  • The game contains references to violence, criminal activities, and mature language.
  • Players must understand the difference between fiction and reality.

5. Virtual Currency and Purchases

5.1 Virtual Currencies

Nero Bay uses three types of virtual currency:

  • Cash — main currency earned from in-game activities
  • Dirty Money — currency earned from illegal in-game activities, requires laundering
  • Gold Coins (GC) — premium currency purchasable with real money

5.2 Real Money Purchases

  • Gold Coins can be purchased through Stripe (secure payment processor).
  • Prices are displayed in USD and include VAT where applicable.
  • All purchases are final and non-refundable, except as required by law.
  • Gold Coins are used exclusively for cosmetics and QoL (Quality of Life) features — they do not provide competitive advantages.

5.3 VIP Subscriptions

  • VIP subscriptions (Silver, Gold, Platinum) are recurring monthly.
  • You can cancel at any time; benefits continue until the end of the paid period.
  • Automatic renewal can be disabled from account settings.

5.4 Right of Withdrawal

Under EU legislation, you have the right of withdrawal within 14 days of purchase. However, by immediately using Gold Coins or activating a VIP subscription, you waive the right of withdrawal pursuant to Art. 16(m) of Directive 2011/83/EU.

6. Code of Conduct

By using Nero Bay, you agree to:

  • Not use discriminatory, racist, sexist, or harassing language in chat.
  • Not exploit bugs or game vulnerabilities. Report them to the team.
  • Not use third-party software (bots, scripts, automation) to play.
  • Not spam, phish, or distribute malicious links.
  • Not impersonate other players, moderators, or administrators.
  • Not conduct real money transactions (RMT) for in-game goods.
  • Respect the decisions of moderators and administrators.

7. Sanctions

Violation of the rules may result in:

  • Warning — in-game notification
  • Temporary mute — chat restriction (1h–7 days)
  • Temporary suspension — temporary ban (1–30 days)
  • Permanent suspension — permanent ban, no right of appeal
  • Confiscation of virtual goods and in-game currency

Moderation decisions are at the team's discretion and are final.

8. Intellectual Property

  • Nero Bay, including its code, design, text, graphics, and music, is the property of VisualTech Studio.
  • You do not have the right to copy, modify, distribute, or reproduce game content.
  • Virtual goods in the game (items, currency, characters) are licensed, not sold. You do not own them.
  • We reserve the right to modify, remove, or add content at any time.

9. Service Availability

  • Nero Bay is provided "as is", without guarantees of 100% availability.
  • We may perform maintenance, updates, or modifications that may temporarily affect access.
  • We are not responsible for losses caused by service interruptions.
  • We reserve the right to shut down the Service with 30 days' notice.

10. Limitation of Liability

To the maximum extent permitted by law, VisualTech Studio is not responsible for:

  • Indirect, incidental, or consequential losses resulting from the use of the Service.
  • Loss of data, game progress, or virtual goods.
  • Actions of other players (including harassment, fraud, or account theft).
  • Technical issues caused by third-party providers (hosting, payments, authentication).

11. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be communicated through in-game notification and/or email. Continued use of the Service after notification constitutes acceptance of the new Terms.

12. Applicable Law

These Terms are governed by the laws of Romania. Any dispute will be resolved by the competent courts in Romania. For EU consumers, consumer protection legislation from the country of residence also applies.
